1. Acceptance of Terms

By accessing or using the Tholus Media LLC website at www.tholusmedia.com (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Site.

These Terms govern use of the Site only. Professional services engagements are governed by separately executed Statements of Work or service agreements.

2. Use of the Site

You may use the Site for lawful purposes related to evaluating or engaging Tholus Media LLC’s professional services. You agree not to:

  • Use the Site for any unlawful purpose or in a manner that could harm Tholus Media LLC or other users.
  • Attempt to gain unauthorized access to any portion of the Site or related systems.
  • Submit false, misleading, or fraudulent information through contact forms.
  • Transmit malicious code, spam, or unsolicited communications.
  • Scrape, crawl, or automate requests to the Site in ways that disrupt its operation.

3. Intellectual Property

To the fullest extent permitted by applicable law, Tholus Media LLC and its owner, officers, and contractors shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of or inability to use the Site, even if advised of the possibility of such damages.

Our total liability for any claim arising from use of the Site shall not exceed one hundred US dollars ($100).

6. Indemnification

You agree to indemnify and hold harmless Tholus Media LLC and its owner from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your violation of these Terms or your use of the Site.

7. Third-Party Links

The Site may link to third-party websites. Tholus Media LLC has no control over those sites and is not responsible for their content, privacy practices, or availability. Links do not imply endorsement.

8. Contact Form Submissions

By submitting a contact form on the Site, you consent to Tholus Media LLC using your submitted information to evaluate and respond to your inquiry. Submission of a form does not create a client-vendor relationship or any obligation on either party. Any binding engagement requires a separately executed agreement.

Posts published on the Site represent the opinions and technical perspectives of Tholus Media LLC. They are provided for informational purposes only and do not constitute professional advice. 10. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Suffolk County, Massachusetts.

We reserve the right to update these Terms at any time. The “Last updated” date reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the updated Terms.
